Update: Nichia gains injunction against Epistar
On September 24, Nichia announced a preliminary attachment order that froze some of Epistar’s bank accounts to preserve funds in the event that damages are awarded to Nichia (see Nichia sues Taiwanese blue LED rival Epistar).
Nichia has now announced that a Taiwanese court has granted a preliminary injunction order, which was executed by Nichia on September 30. The execution of the preliminary injunction order will prevent Epistar from making, selling, using, importing and marketing products that allegedly infringe on Nichia’s patent.
Nichia says that it intends to take additional necessary legal action against other Epistar products, other products of other manufacturers in Taiwan and/or assembly manufacturers that use infringing products.
The company believes that these actions are necessary in order to protect its intellectual property and its licensing partners legal rights.
